Piglet castration: Cologne Higher Regional Court rejects claims for damages against the Federal Republic of Germany

Danes had asked for € 140 million

In a dispute over the import of Danish pork to Germany, the Cologne Higher Regional Court declared a claim for damages against the Federal Republic of Germany to be unfounded in a judgment announced on March 15, 2012. The plaintiff - an industry association of cooperatively organized Danish slaughterhouses and pig breeders - had accused the Federal Republic of a violation of European Community law and alleged that the Danish pig farmers suffered damage of around 140 million euros as a result. The cause of the dispute was the intention of Danish pig farmers to sell the meat of non-castrated male pigs and also to export it to Germany. However, this meat can have a strong sexual odor and strong taste, which is why every male animal must first be tested for human health after slaughter. Up until 1999, the Federal Republic of Germany prescribed a specific test method that was not provided in Denmark at the time. The European Court of Justice ruled at the end of 1998 that this had been contradicted as a result of an EU directive from 1993, according to which the respective national test methods and test results of the exporting countries should also be recognized in the other member states. The plaintiff had asserted with the action that due to the non-compliant legal situation in Germany, the Danish pig breeders had been forced to castrate all male pigs, which resulted in additional costs for the production in the amount claimed.
